Pathway overview
For executives or managers transferring from an affiliated foreign office to a U.S. office of the same employer (or establishing a new U.S. office).
Verified directly from USCIS's own eligibility page: the U.S. employer must have a qualifying relationship (parent company, branch, subsidiary, or affiliate) with a foreign company, and be doing business in both the U.S. and at least one other country for the duration of your L-1A stay. You must generally have worked for the qualifying organization abroad for one continuous year within the three years immediately preceding admission, and be coming to provide service in an executive or managerial capacity — a standard defined by INA 101(a)(44) and 8 CFR 214.2(l)(1)(ii), which is a genuine officer-judgment call this tool doesn't reduce to a checked rule.
