Verified directly from USCIS's own eligibility page: you need a job offer for a temporary, seasonal, or peak-load non-agricultural position, and your U.S. employer (or U.S. agent) must have obtained an approved Temporary Labor Certification (TLC) from the Department of Labor before filing Form I-129 on your behalf. H-2B is subject to a real annual numerical cap — 66,000 statutory (33,000 for jobs starting in the first half of the fiscal year, 33,000 for the second half) — though DHS and DOL jointly announced a temporary FY2026 supplemental increase of up to 64,716 additional visas, restricted to employers who would otherwise suffer irreparable harm.
