For citizens of a U.S. treaty country who have invested, or are actively investing, a substantial amount in a real and operating U.S. business they will direct.
Verified directly from USCIS's own eligibility page: you must be a citizen of a country that maintains a qualifying trade/investment treaty with the U.S. (80+ countries currently do), have invested — or be actively investing — a substantial amount of capital in a real, operating, non-marginal U.S. business, with those funds genuinely at risk, and be coming to the U.S. to develop and direct that enterprise (a purely passive investment, like buying shares or holding undeveloped property, doesn't qualify). There's no fixed dollar minimum by design: officers apply a proportionality test, so a lower-cost business needs a higher percentage invested — in practice, successful investments commonly range from roughly $100,000 to $300,000, but this isn't a legal floor.
